Your acceptance

By using this site, sending a request through it, or contacting us through it, you agree to these terms. If you do not agree, please do not use the site.

If you are acting for a church, company or other organization, you confirm that you are at least 18 and authorized to act for it.

What this site is

This site is operated by Ages Productions, Inc. of Miami, Florida. It exists to show what we sell and to take requests. It is informational and a way to reach us — nothing more.

Nothing on this site is a binding offer, a reservation of stock, or a guarantee that any product is available at any particular price. No payment is taken here.

Requests, quotes and orders

The request list on this site is a convenience for you — somewhere to gather what you are considering and send it to us in one go. It is not a checkout. Adding to it reserves nothing, charges nothing, and holds no price.

Sending the request does not create an order.

Quotes and invoices are issued by Ages Productions, Inc. — by the company, not by this website. A person prepares them against confirmed distributor stock and your actual requirements. This site does not generate them, does not price them, and cannot commit the company to anything.

A sale exists only once we have issued you a written quote or invoice and you have accepted it. We may decline or withdraw a quote before it is accepted.

Nothing on this site guarantees, replaces or supersedes an invoice we issue. Where anything here differs from your quote or invoice — a price, a specification, an availability statement, or these terms — the quote or invoice governs.

Pricing

Prices shown on this site are the manufacturer's suggested retail price in U.S. dollars, for the product alone. They are shown so you can plan, and they can change without notice.

They do not include freight, insurance, sales or use tax, duties, installation, or any other service. Your actual figure — including whichever of those apply — comes back in the quote, before you commit to anything.

Prices are sometimes wrong. If a price here is mistaken, we may correct it and decline or re-quote any request made against it. We will tell you before doing anything else.

The request list records the price shown when you added each item and keeps it in your browser between visits, so a figure in that list may no longer be current. Any total it shows is an estimate at MSRP, not a quote.

Availability

We do not publish live stock, because distributor stock moves constantly and a number shown here would be wrong as often as it was right. We confirm availability, and colour where a product has options, when we quote.

Availability is confirmed at the time of quoting and is not held indefinitely.

Delivery and timing

Delivery times depend on distributor stock and on the carrier. Any date we give you before you order is an estimate, not a promise.

The delivery terms that apply to your order — shipping method, timing, freight cost, and the point at which risk of loss passes to you — are set out in the quote and invoice for that order.

We aim to respond to requests within one business day. That is our normal practice, not a guaranteed response time.

Product specifications

The specifications on this site are the manufacturer's own published figures, reproduced for convenience. They can be changed or corrected by the manufacturer at any time, and the manufacturer's current documentation is the authority, not this page.

Do not rely on figures here for structural, electrical, network, mounting, rigging, load or permitting decisions. Confirm anything load-bearing — mounting, power, cabling, throw distance — against current manufacturer documentation and with whoever is doing your install.

Products, warranty and support

Condition and channel. We supply new, in-box units purchased through authorized distribution. If we ever cannot supply a unit on that basis, we will tell you before you order rather than substitute something else.

The product warranty is the manufacturer's, not ours. BirdDog products carry BirdDog's limited five-year manufacturer warranty, on BirdDog's terms, and warranty service is provided by BirdDog under that warranty. We do not extend it, shorten it, or add a warranty of our own. We will send you the manufacturer's current warranty text on request before you order.

What we do, and what we do not do

We will help you specify a system, source it through authorized distribution, and speak with your installer about how it goes in.

That help is advisory. It is based on what you tell us about the room. It is not an engineering assessment, a site survey, or a substitute for one, and you are responsible for confirming that the equipment suits your space, your power and your network before you order — with your installer, and against the manufacturer's current documentation.

We do not perform installation, and we do not supply or arrange installers. Physical installation, rigging, mounting, electrical work, network configuration and any permits are yours to arrange with qualified people. We are not responsible for work performed by anyone else.

Terms of sale

Payment terms, delivery, shipping and risk of loss, sales and use tax, cancellations, returns and RMA handling are set out in the quote and invoice for your order. Those are proper commercial documents issued by the company, carrying the information required of them.

They are not published here, because they depend on what is being sold, where it is going, and what the manufacturer's and distributor's own policies allow — and because this website is not where that agreement is made.

Ask before you order if any of them matter to your decision. We would rather answer up front than have you find out afterwards.

Acceptable use

Do not submit false or misleading information, use the request form to send spam or anything unlawful, attempt to gain unauthorized access to the site or its infrastructure, introduce malware, or scrape the site to build a competing listing. Do not use the site for any unlawful purpose.

Intellectual property

The text, layout and design of this site belong to Ages Productions, Inc. You are welcome to read it, share it and use it to plan a purchase. Reproducing it commercially requires written permission.

BirdDog, NDI and other product names, logos, imagery and marks appearing here belong to their respective owners. They are used to identify the products we offer for sale. Product photography and specifications are the manufacturer's and are reproduced to describe those products. Their appearance here transfers no right in them to you, and does not imply that any mark owner endorses this site.

We are an independent reseller. Ages Productions, Inc. is not BirdDog, is not an agent of BirdDog, and is not authorized to make representations on BirdDog's behalf. Nothing we say binds the manufacturer, and nothing on this site changes the manufacturer's own warranty or terms.

Third-party services and links

This site depends on services we do not control — form delivery, hosting, spam protection and font delivery — and links to other sites. We are not responsible for those services or for the content of any site we link to. The Privacy Policy names the providers involved.

Disclaimer

This site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that everything on it is current or accurate at the moment you read it.

This disclaimer is about the site. It does not affect the manufacturer's warranty on a product you buy.

Limitation of liability

To the fullest extent the law allows, Ages Productions, Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising from your use of this site, from anything you relied on here, or from any advice, specification help or other assistance we give you before an order is placed.

Liability relating to a product you actually order is governed by the quote and invoice for that order, together with the manufacturer's warranty.

Privacy

What we collect and how long we keep it is set out in the Privacy Policy. Our Accessibility statement covers how the site is built for assistive technology.

General

These terms, together with the Privacy Policy, are the whole agreement between us about your use of this site. They replace anything said earlier about the site. They do not govern a purchase: where anything here differs from a quote or invoice we have issued you, the quote or invoice governs.

If any part of these terms is held unenforceable, the rest stays in force, and the unenforceable part applies to the greatest extent the law allows.

We may assign these terms in connection with a sale or reorganization of our business. You may not assign them without our written consent.

If we do not enforce a provision, that is not a waiver of it.

Any claim arising from your use of this site must be brought within one year of when it arose, to the extent the law permits a shorter period than would otherwise apply.

Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from this site or from these terms will be brought exclusively in the state courts located in Miami-Dade County, Florida, or in the United States District Court for the Southern District of Florida where that court has jurisdiction. You consent to that jurisdiction and venue, and waive any objection based on inconvenient forum.

Changes

We may update these terms. The effective date at the top changes when we do, and continuing to use the site after that means you accept the current version.
